1.1 This Privacy Policy describes how we at BKYNDR (referred to as “We”, or “Us”) collect, use, store, share and protect your personal information in connection with your use of both the platform accessible through the www.bkyndr.com domain name (referred to as the “Site”) and the services we may offer through the Site from time to time, consisting mainly of an online tool, survey and other services (referred to as the “Survey” and “Services”, respectively).

2. SCOPE OF POLICY

2.1 This Privacy Policy is an integral part of our Site and sets out the basis on which any personal data We collect from you, or that you provide to us, will be processed. Please read the following passages carefully to understand our practices regarding your personal data and how We will process it.

2.2 This Privacy Policy applies to your use of:
• All BKYNDR applications hosted on www.bkyndr.com once you have
accessed the Site on your desktop, your mobile telephone, tablet or handheld device.
• Any of the Services accessible through the Site including the Survey provided by BKYNDR

2.3 Your personal information you provide when using the Site, the Survey and/or the Services is subject to this Privacy Policy, and you will be prompted to read and accept it.

3. PROVISION OF OUR SITE

3.1 Description and scope of data processing

Each time you visit our Site, our systems collect data and information from your system. The data is also stored in the log files of our system. The temporary storage of your personal data is necessary in order to deliver the Site to your device. Storage of your personal data to merge it with other personal data does not take place. For reasons of data protection, the host name and respectively the IP address of the client accessing our Site are anonymized in the log files. Where possible, your personal data is anonymized.

3.2 Purpose of data processing

3.2.1 Some of your personal data is used to keep the Site secure and operational and prevent abusive activity (e.g. fraud, spam, phishing activities, etc.).

3.2.2 Furthermore, and only with your prior consent, we may perform statistical and other analysis on information we collect (technical and metadata); analyze and measure user behavior to understand how you use our Services; in order to improve and optimize our performance of our Site and Services. 3.3 Legal basis of data processing

3.3.1 The legal basis for the temporary storage of your personal data in log files is our legitimate interest in accordance with Article 6 (1) (f) GDPR. Our legitimate interest lies in the proper provision of the information you have requested while ensuring the information security of our Site.

3.3.2 The legal basis for using your personal data for statistical and functional features depends on your qualified consent in line with Article 6 (1) (a) GDPR. We ask you for your explicit consent to use this data through the cookie banner and settings (see also section 6. COOKIES). As you give your consent freely, you have the right to revoke this consent at any time for the future. You can do so by rejecting when the cookie banner is prompted as well as in the cookie settings.

3.4 Categories of personal data being processed

The following categories of personal data will be collected when visiting our Site:

(3) Internet Service Provider
(4) Client IP address
(5) Time stamp of access
(6) Websites from which you have been referred to our Site (so-called referrer)

3.5 Storage period for personal data

The data collected and processed when you visit our Site is usually stored for a maximum of seven days. Beyond this period, only the IP address is saved, and usually only partially.

3.6.1 The collection of your personal data and its temporary storage in the log files is essential for the operation and secure provision of this Site. There is consequently no possibility for you to object (in that case, you might want to leave our Site now, which we would regret very much).

3.6.2 With regards to the storage and processing of your personal data for statistical and functional reasons, as described above, you give your consent and thus can revoke that consent at any time in the cookie settings. With regards to this data, you have the right to rectification, erasure or restriction of your personal data that we legitimately collect and process. 3.7 Recipients of personal data

For the provision of our Site and Services we use the services of other providers (called “processors of data” within this context, or simply “processors”) that process your personal data on our behalf. This transfer of your personal data is regulated in Art. 28 GDPR. In accordance with that article, we have concluded corresponding contracts with the processors in order for them to comply with the GDPR and protect your personal data. No other third parties receive your personal data.

4.1 Description and scope of data processing

When you take part in the online Survey on our Site, our system automatically collects data and information from your system. This data is also stored in the log files of our system. Storage of your personal data to merge it with other personal data does not take place. For reasons of data protection, the host name and respectively the IP address of the client accessing our Site are anonymized in the log files. Where possible, your personal data is anonymized.

4.2 Purpose of data processing

4.2.1 As explained in Section 3.2.1, some of your personal data collected when taking part in the online Survey is needed to keep it secure and operational and prevent abusive activity (e.g. fraud, spam, phishing activities, etc.).

4.2.2 Other personal information collected is necessary in order to render the Survey and its features, including the processing of your answers and the delivery of the Survey results to you. This includes sociodemographic personal data for purposes of aggregating data over groups of participants to further develop our Survey and Services. In this context, your personal data is being anonymized and not merged with any other data sets that can identify you as an individual.

4.3 Legal basis of data processing

4.3.1 The legal basis for the temporary storage of your personal data in log files is our legitimate interest in accordance with Article 6 (1) (f) GDPR. Our legitimate interest lies in the proper provision of the information you have requested while ensuring the information security of our Survey.

4.3.2 The legal basis for using your personal data for statistical and functional features, as well as for data aggregation as a participant of the Survey is based on your explicit consent given by you in line with Article 6 (1) (a) GDPR. Prior to taking part in the survey, you are prompted to give your explicit consent while acknowledging this Privacy Policy.

4.4 Categories of personal data being processed

The following categories of personal data will be collected when taking part in the survey:

(1) Browser type and version used
(2) Operating system of your device
(3) Internet Service Provider
(4) Your IP address
(5) Time stamp of website access
(6) Your answers to the questions of the survey (especially sociodemographic data)
(7) Your email (in case you choose to receive your results per email)

4.5 Storage period for personal data

4.5.1 The data collected and processed when taking part in our Survey is usually stored for a maximum of seven days.

4.5.2 Your personal data stored and processed while doing the Survey is only stored until the results have been processed and delivered to you. After delivering the Survey result, your personal data is being anonymized before being aggregated with other anonymized user data for further research.

4.6 Right of rectification, erasure or restriction of personal data

4.6.1 The collection of your personal data and its temporary storage in the log files is essential for the operation and secure provision of the Survey. There is consequently no possibility for you to object (in that case, you might want to not take part in the Survey, which we would regret very much).

4.6.2 With regards to the storage and processing of your personal data for processing your Survey answers and delivering the result to you, you have the right to rectification, erasure or restriction of your personal data that we legitimately collect and process as long as we store this data and this data has not yet been anonymized (see “Storage period for personal data” above). Additionally, you can exercise your rights (see Section 7 “YOUR GENERAL RIGHTS” below) granted to you by the GDPR at any time.

5. COMMUNICATION VIA CONTACT FORMS AND EMAIL

5.1 Description and scope of data processing

5.1.1 A contact form is available on our Site that can be used to contact us electronically. If you use this contact form, the data entered into the contact fields will be transmitted to us and stored for processing your request.

5.1.2 Alternatively, you can contact us directly using the email address provided on our Site. In this case, your personal data transmitted with your email will be stored. Other personal data processed during the sending and receiving process (e.g. as described in Section 3, as well as email headers) serve to prevent misuse of the contact form and our email service, and to ensure the integrity of our information technology systems.

5.2 Purpose of data processing

We process your personal data provided by you through the contact form or directly via email in order to process your request at hand and not for any other purpose. As soon as the request has been cleared, the communication is finished and your personal data will be deleted.

5.3 Legal basis of data processing

5.3.1 For the processing of your personal data via the contact form on our Site, your consent is obtained prior to submitting your message through mentioned contact form. You will be prompted to acknowledge this Privacy Policy. The legal basis for processing that data is Article 6 (1) (a) GDPR.

5.3.2 The legal basis for processing data that is transmitted when sending an email directly to us is Article 6 (1) (f) GDPR: our legitimate interest.

5.3.3 In case the aim of the email contact is to conclude a contract, the legal basis for processing your personal data is Article 6 (1) (b) GDPR.

5.4 Categories of personal data being processed

In addition to the categories of personal data mentioned in Section 3.4, the following voluntary categories of personal data are stored:

(1) Your name
(2) Your email address
(3) If applicable, any further personal data that you provide to us via your messages.

5.5 Storage period for personal data

5.5.1 Your personal data will be deleted with undue delay when the respective request of yours and the belonging conversation has ended. The conversation is ended when it can be inferred from the circumstances that the matter in question has been clarified.

5.5.2 The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.

5.6 Right of rectification, erasure or restriction of personal data

With regards to the storage and processing of your personal data for processing your request by contact form or email, you have the right to rectification, erasure or restriction of your personal data that. Additionally, you can exercise your rights (see Section 7 “YOUR GENERAL RIGHTS” below) granted to you by the GDPR at any time.

5.7 Recipient of personal data

5.7.1 In coherence with Section 3.7 of this policy, we pass on your personal data to processors on the legal basis of Art. 28 GDPR in order to process your request.

5.7.2 Your personal data – in particular your email address – will not be passed on to third parties without your prior consent and only if it is necessary to clarify your request at hand.

6. COOKIES

6.1 What cookies are
In the IT and computer realm, cookies are small text files that are generated when you access our Site and that collect information when you browse our Site. Cookies can increase security of our Site, and make your browsing experience more convenient, and sometimes necessary: if you want to take part in our Survey, you have to agree on some cookies being used.
